Contest Terms and Conditions
1. ELIGIBILITY AND PARTICIPATION.
- This contest is sponsored by WeLoveBC.ca.
- This contest is open to anyone currently residing in the province of British Columbia, Canada, except employees of WeLoveBC.ca, its contest sponsor, advertising and promotional agencies and their respective affiliates and associates and such employees' family members.
- Contestants are responsible for compliance with applicable laws in jurisdictions where they reside.
- By entering this contest, entrants automatically agree to be bound by the terms of this contest as listed in this Contest Terms and Conditions.
- Failure to adhere to the terms and conditions listed in this Contest Terms and Conditions will result in disqualification of any submitted entries, and the nullification of contestant privileges to further participate in the contest.
2. SUBMISSIONS OF ENTRIES AND DEADLINES.
- The Contest will be opened for entry submissions starting August 4, 2008. All entries must submitted no later than 12pm PST, Monday, October 7, 2008. Late entries will be rejected.
- To be eligible to participate, entrants must be registered for a WeLoveBC.ca Photo Gallery account and submit their entry through the website. In signing up for a WeLoveBC.ca Photo Gallery account, entrants must provide their name, valid email address, and all other required information.
- Incomplete entry forms will be deemed disqualified and will be rejected. WeLoveBC.ca is not responsible for any lost, misdirected or delayed entries. There is also no responsibility or liability for any potential entrant's inability to access the official Contest submission function for contest entry. Entries received by telephone, fax, courier, personal delivery or Customer Service Ticket or any other method other than the official Contest website will not be accepted.
- Each submission must be the property of the entrant, or entrant must have proof of permission from the owner/author of the property to distribute the content.
- Each contestant may submit only one photograph. Only one prize per contestant will be awarded.
- By submitting any entry, entrants agree to be bound by the terms and conditions set forth in this document without limitation. Entries must not include content that are unlawful, harmful, vulgar, obscene, hateful, or racially, ethnically or otherwise objectionable, the determination of which is up to the sole discretion of WeLoveBC.ca.
3. WINNER SELECTION AND NOTIFICATION.
- Judging. All contest entries will be displayed on our website for visitors to vote at 5pm PT on October 7, 2008. Each visitor will be allowed to vote for as many photographs as they want, with the limitation of one vote per photograph. Public voting will have a period of two (2) weeks from the deadline to vote. After that, entries will be reviewed and voted by a panel of staff at WeLoveBC.ca for one day. Entries receiving the highest amount of votes, from both the public and staff voting, will be declared the winners.
- Selection Criteria. Entries will be selected based on criteria including but not limited to: i) completeness of image, ii) editorial judgment in image, iii) effective use of color and/or lighting, iv) quality of images, v) uniqueness/originality of image, vi) appropriateness of theme, and vii) overall appearance of photograph.
- Dates of Voting. The two weeks of public voting will begin at 5pm PST on October 7, 2008, and will close at 5pm PST on October 21, 2008. On October 22, 2008, staff and developers ofWeLoveBC.ca will participate in the voting process. These dates are subject to change depending upon the number of qualified entries and contest participants.
- Notification of Winners. Winners of prizes shall be notified immediately following the announcement of the winners on the WeLoveBC.ca website on October 24, 2008. As a condition to receipt of their prize, prize winners maybe required to signed and return the Contest Prize Release Form within 72 hours of notification.
4. PRIZES
- First prize. The Contest grand prize winner will win an ACER Aspire One Intel Atom Mini Notebook, sponsored by NCIX.
- Second prize. The Contest second prize winner will win an Apple iPod Touch 8GB, sponsored by Compu2000.
- Third prize. The Contest third prize winner will win a Canon PowerShot A560 7.1MP Digital Camera and a 1-year 20GB Photo Gallery Hosting, sponsored by Doteasy.com.
- Notification of Winners. Winners of prizes shall be notified immediately following the announcement of the winners on the WeLoveBC.ca website on October 24, 2008. As a condition to receipt of their prize, prize winners maybe required to signed and return the Contest Prize Release Form within 72 hours of notification.
- Consolation prize. There will be 12 consolation winners who will receive a $50 gift certificate from a local restaurant, gas station, spa, or sports specialty company.
- Odds of winning a prize will vary depending upon the number of actual Contest participants. In the event any entry is deemed ineligible or disqualified, WeLoveBC.ca may award the prizes to alternate entries as it deems suitable. In any event that the prize cannot be awarded, WeLoveBC.ca may withdraw the winner's title, and all unclaimed prize(s) will be forfeited and WeLoveBC.ca may select an alternate winner.
- In accepting the prizes, the contest winners acknowledge that WeLoveBC.ca may not be held liable for any loss, damages or injury associated with accepting or using the prize(s).
5. CONTEST SUBMISSION AGREEMENT.
- Original Works. All entries must be the original creations of the entrants, unless written authorization from the intellectual property owner is provided at the time of entry submission. Contestants agree to indemnify and hold harmless WeLoveBC.ca and its contest sponsors from any copyright, trademark, or other intellectual property infringement claim or liability with regard to their submissions.
- Submitted Entries. By submitting any design entry for the Contest, the contest grants WeLoveBC.ca a non-exclusive, worldwide, royalty-free right for the duration of the contest to display a screenshot of the submitted entry in association with this contest on its websites, for commercial, business, and trade purposes, as well as for advertising and/or publicity purposes. Additionally, contestants hereby agree and acknowledge that WeLoveBC.ca may, in its sole discretion, display the screenshot of submitted entries, in whole or in part, distorted in character or form, on, but not limited to, the WeLoveBC.ca website.
- Submitted Content. Contestants may NOT submit offensive, pornographic, obscene, criminal or adult themes, links or images. WeLoveBC.ca reserve the rights to decide what constitutes deletion, suspension, or banning within the contest.
6. GENERAL
- Releases. All entrants, as a condition of entry into the Contest, agree to release WeLoveBC.ca staff and its Contest sponsors from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property associated or sustained in connection with participation in any and all aspects of the Contest, including accessing the Contest, submitting an entry, the receipt, ownership or use of any prize. Each prize winner bears all risk of loss or damage to his or her applicable prize after it has been delivered.
- Prize Responsibility. All prize winners will be responsible for any and all federal, state and/or local taxes resulting from acceptance of any and all prizes associated with this Contest. Prize winner cannot assign or transfer the prize to another person. No prize substitution or changes are allowed. All prizes are subject to availability. If a prize cannot be awarded due to circumstances beyond the control of WeLoveBC.ca, a substitute prize of equal or greater retail value may be awarded.
- Limitation of Liability. Neither WeLoveBC.ca, its staff, nor its Contest sponsors assume any responsibility or liability for (i) any incorrect or inaccurate entry form information, or for any faulty or failed electronic data transmissions; (ii) any authorized access to, or theft, destruction or alteration of entry forms or submissions at any point in the operation of this Contest; (iii) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the submission of an entry or the operation of the Contest; (iv) inaccessibility or unavailability of the Internet; or (v) any injury or loss of participants which may be related to or resulting from any attempt to participate in the Contest or download of any materials in the Contest.
- Disputes. You agree that you will submit any dispute you may have with regard the conduct of the Contest, interpretation of the Rules, and/or awarding of prizes to WeLoveBC.ca, whose decision regarding such dispute shall be binding and final. All disputes must be submitted in writing, and sent to us at: contest@welovebc.ca.
- Winners. All voted decisions are final.
- Winner Announcement. A list of prize winners will be available on the WeLoveBC.ca website on October 24, 2008. All prize winners will be further contacted by WeLoveBC.ca via email for the claiming of their prizes.
- Age of Participation. Any participant under the age of 16 is required to notify WeLoveBC.ca before entering in to any competition processes. Participants under the age of 16 may be required to provide proof of parental consent, either in writing by postal mail or facsimile transmittal, at any time during the competition process. If a winner of any award is under the age of 16, parental consent in writing by postal mail or facsimile transmittal will be required.
- Terms. WeLoveBC.ca reserves the right to abbreviate, modify, suspend, cancel, or terminate this Contest at any time without prior notice, and without further obligation or liability to you. WeLoveBC.ca also reserves the right to change this Terms and conditions at any time without prior notice.
